Should you take notes after an accident?  Definitely.

Taking notes after an accident may not be the first thing on your mind. However, it may be one of the most important things you do aside from getting the appropriate medical care and contacting a reputable attorney.

While the memories are still fresh and you can quietly observe, we recommend that you take notes about what happened.  These notes can become a critical part of your legal case and may serve as evidence for your claim.

Grab your smartphone or a pen, and jot down the following data points.

Describe the accident and be sure to include:

  • Day and time
  • Where you were going or what you were doing
  • Any external factors such as weather, noise, traffic, people, road signs
  • Relevant information such as who was wearing seatbelts or using helmets (motorcycles or bicycles)
  • Descriptions of other individuals involved including gender, age, and description
  • What you observed of the other individuals including if they were speeding, weaving through traffic, using a cellphone, or not using headlights
  • Anything you noticed such as odors, odd behavior, changing seats in a vehicle, throwing something out a window or door, or damage to a vehicle, sign, or object
  • Anything you heard others say
  • Hand-drawn diagram of accident

Describe your injuries including:

  • How the accident affected you
  • Physical symptoms such as pain, soreness, discomfort
  • Mental symptoms such as anxiety, fear, emotional stress, or other concerns

Detail any conversations including:

  • Conversations with medical personnel, insurance companies, or witnesses
  • Date, time, and type of communication

Request contact information for other individuals involved and witnesses

Finally, in the days following the accident, note how the accident affected you including:

  • Missed classes or work
  • Financial losses
  • Professional activities
  • Family or personal activities
  • Fitness activities and social engagements
  • Once completed, make a copy of the notes, and store the copies in a safe and secure location until you communicate with your attorney.
